Zoning Eastham's current zoning doesn't provide for the installation and operation of commercial wind turbines. It is very important for the Town to have a protective zoning bylaw that properly deals with the siting and operation of large commercial wind turbines. There are currently two zoning proposals under consideration. One is proposed by a citizen petition and is known as the Hesse Bylaw Amendment. A second is proposed by the Eastham Energy Committee and the Board of Selectman. It is based on the so-called MA DOER Model Wind Turbine Bylaw. A zoning bylaw's primary goal should be to protect the health, safety and property rights of the residents and property owners in the Town of Eastham. The zoning bylaw should be based on well accepted and proven norms and standards. It should not be written primarily to allow development of any specific site or location in town.
California probably has more experience with commercial wind turbines than any other state. Below is a table of the required setbacks in various CA counties. The DOER Model bylaw provides setbacks which are irresponsible for areas like Eastham. When it comes to safety setbacks, Eastham should adopt California's responsible wind power setbacks.
